A frozen list is who was selected, never a licence to send.

A campaign cannot be created from a segment that does not assert SMS marketing consent. Then every recipient is checked again against the consent ledger immediately before the provider call, the same check the inbox and the flow engine use.

    Carriers split long messages into parts and charge each one. The part count is arithmetic. The cost is labelled an estimate because carrier fees vary by destination.

    Somebody who withdraws consent between the freeze and their turn is skipped, with the reason recorded on their own row. Skipped messages are never charged.

    An audience over the limit is refused rather than truncated, so nobody is quietly left out of a send you approved.

CASL, enforced by the CRTC, and how the platform holds the line.

Canada's Anti-Spam Legislation covers every commercial electronic message, texts and email alike, and puts the burden of proving consent on the sender. Here is what it asks of you and what RealViu does about each part.

What CASL requires

A summary for orientation, not legal advice.

Consent first
Express consent is an opt-in the person took themselves and lasts until withdrawn. Implied consent comes from a relationship and expires: two years after a purchase or contract, six months after an inquiry.
Identification
Every message names the business sending it, gives a mailing address and a phone number, email or web address. A text may link to a page that carries them.
Unsubscribe
A free, working way out, by the same means the message came. Requests are honoured within 10 business days and the mechanism stays valid for 60 days.
Proof
The sender must be able to show consent existed. If it cannot be shown, it did not exist.
Exposure
Penalties of up to $1 million per violation for an individual and $10 million for a business. Directors can be personally liable, and platforms that enable violations can be too.

Consent first
Forms capture per-channel, opt-in consent with versioned wording. A campaign is refused unless its segment asserts SMS marketing consent, and every recipient is checked again right before their message.
Identification
Messages leave from your brokerage's own number, and you write the text. Put your name in it and tell people how to reply STOP. Campaign email carries your identification and an unsubscribe link by construction.
Unsubscribe
STOP and its siblings are honoured on the server the moment they arrive, for texting and marketing at once. An email unsubscribe writes the same ledger. Nobody has to remove anyone by hand.
Proof
The consent ledger keeps the basis, source, wording version and fingerprints for every event, and the campaign keeps the audience it froze with a reason on every skipped row.
Exposure
Consent controls cannot be switched off. The one thing the tools cannot do is know whether a record you attested or entered by hand is true. That part is yours, and the Terms say so.

Your responsibility, in plain words

RealViu is a platform provider. Your brokerage and your agents decide who is contacted, on what consent basis, and with what content. We give you the tools to capture, record and enforce consent, and those tools act on the records in your account.

If a record is wrong because consent was attested that did not exist, recorded by hand without evidence, or a purchased or scraped list was imported, the messages that follow are yours, not ours. We accept no liability for any text or email sent on behalf of a brokerage or agent, or for a consent control that was overridden.

What happens if the rules are broken

  • Immediate suspension of the account or its sending features, without prior notice, for any violation: sending without a consent basis, ignoring or circumventing an opt-out, falsifying an attestation, or unlawful content.
  • Suspension does not undo messages already sent, and you remain responsible for them.
  • We keep the ledger and message logs under our retention schedule and will produce them to answer a complaint or a CRTC inquiry.

A campaign runs in batches from your browser. Closing the tab pauses it and Continue resumes without sending anyone twice. Stop is terminal. A monthly spending cap can end a send on its own.

Stop sending ends the campaign for good. Everyone not yet attempted stays unsent with that reason on their row, and the stop is enforced on the server, so a browser that missed it cannot keep going.

  • A stopped campaign cannot be resumed. Create a new one to reach the rest.

A spending cap that actually stops

Set a monthly SMS limit for the brokerage. When a send would cross it, the batch ends and the screen says so. You are billed by Twilio for every message part, on your own account, so the estimate before you send is the number to check.

  • Managed numbers or your own Twilio account.
  • Carrier registration for Canadian and US numbers is required before the first campaign.

Delivery you can read

Past campaigns show sent, failed and skipped counts, and group failures by reason with the carrier's code and what to do about it. Replies land in the Communications Inbox as ordinary conversations.

  • Skipped means consent, not a fault. Failed means the carrier could not deliver.
  • The message and its part count are frozen at confirm, so the bill matches the estimate's arithmetic.

Message parts are billed by Twilio on your own account at carrier rates. The estimate before every send counts the parts exactly and labels the dollars as an estimate.

Who can send a Mass SMS?

Brokerage administrators, from the brokerage portal. Agents build flows and work the inbox, but one text to a whole audience from the brokerage's number is an admin decision.

What happens when someone replies STOP?

The reply is recognised on the server the moment it arrives, consent for texting and for marketing is withdrawn at once, and the event is written to the ledger with the carrier keyword as evidence. That person is skipped in every campaign and flow from then on, and nobody has to remove them by hand.

Why were some people skipped?

Because their consent changed between the moment the audience was frozen and their turn to be sent. Every recipient is checked again immediately before the provider call. A skipped message is never sent and never charged, and the reason sits on that person's row.

Can I cancel a campaign?

You can stop it, and a stop is final. Messages already sent cannot be recalled, everyone not yet attempted stays unsent, and the campaign cannot be resumed. Closing the tab only pauses it; Continue resumes without sending anyone twice.

What does it cost?

Twilio bills every message part on your own account at carrier rates. Before you send, the screen shows the exact number of parts and an estimated dollar figure, labelled as an estimate because carrier fees vary by destination. A monthly spending cap can end a send on its own.

Is this compliant with Canadian law?

The tools are built around CASL as enforced by the CRTC: consent before sending, honoured opt-outs, a ledger that can prove both, and identification from your own number. Compliance also depends on the records you create. Attesting consent you do not have, or importing a list you did not earn, is a violation of our Terms and leads to immediate suspension.
